Don't let financial institutions steal your family's peace of mind.
“They keep barging into my home uninvited”
You have the absolute right to refuse entry to any recovery agent or bank representative. Your home is your protected space. No one can enter without your explicit permission or invitation - regardless of how much you owe.
Legal Backing: Article 21 of the Constitution of India guarantees the Right to Privacy and Personal Liberty. The Supreme Court in Justice K.S. Puttaswamy v. Union of India (2017) reaffirmed that privacy is a fundamental right. RBI Master Circular on Fair Practice Code for Lenders prohibits recovery agents from making unauthorised visits.
“They call me a hundred times a day - morning, night, even at 2 AM”
You have the right to be contacted only between 7 AM and 7 PM. Repeated calls, calls at odd hours, abusive language on calls, and threatening behaviour are all strictly prohibited.
Legal Backing: RBI Circular DBOD.Leg.BC.75/09.07.005/2002-03 on Guidelines on Fair Practice Code. RBI Master Direction on Outsourcing of Financial Services - recovery agents must follow a Code of Conduct. Violations can be reported to the RBI Banking Ombudsman under the Banking Ombudsman Scheme, 2006.
“My phone won't stop - messages, calls, voice blasts from ten different numbers.”
You have the right to be free from spam calls, bulk voice blasts, and multi-number bombardment. Banks and NBFCs cannot use automated dialling systems or third-party calling networks to overwhelm you.
Legal Backing: TRAI Telecom Commercial Communications Customer Preference Regulations, 2018 prohibit unsolicited commercial communications. RBI Fair Practice Code prohibits use of excessive or misleading communication. Complaints can be filed on the TRAI DND portal or with the RBI Ombudsman.
“The bank told my boss - now everyone at my office knows I have a loan problem.”
You have the right to complete financial privacy. Your loan details, dues, default status, or any financial information cannot be shared with your employer, family, neighbours, or any third party without your consent.
Legal Backing: RBI Master Circular - Fair Practice Code for NBFCs (RBI/2015-16/14) explicitly prohibits disclosure of borrower information to unauthorised parties. The Information Technology Act, 2000 (Section 72A) penalises unauthorised disclosure of personal information. The right to financial privacy is protected under the Puttaswamy judgment.
“Recovery agents came to my house and started taking things away.”
You have the right to retain your belongings and property unless a court of law has authorised seizure. No bank, NBFC, or recovery agent can physically remove your assets without following due legal process.
Legal Backing: The SARFAESI Act, 2002 requires banks to issue a 60-day notice before initiating any asset recovery action - and only for secured loans. Seizure without notice or court order is illegal. United Bank of India v. Satyawati Tondon (2010) affirmed that borrowers must be given fair opportunity before asset recovery. Personal belongings not pledged as collateral cannot be touched under any circumstance.
“They told my neighbours and relatives about my loan - I'm humiliated everywhere I go.”
You have the right to dignity. No bank or recovery agent can publicly shame you, disclose your financial situation to your social circle, or use embarrassment as a tactic to recover dues.
Legal Backing: RBI Guidelines on Fair Practices Code strictly prohibit recovery agents from contacting third parties other than guarantors. Such behaviour constitutes mental harassment and can attract action under Section 506 (criminal intimidation) and Section 509 (outraging modesty/dignity) of the IPC. The Consumer Protection Act, 2019 also provides recourse for mental agony caused by deficient or abusive service.
